A FORMER police officer will be re-sentenced in the Honiara Magistrate Courts after successfully appealing his sentence.
Ubaldo Tiva was sentenced in 2010 for one count of reckless and dangerous driving and careless driving.
The court has imposed a total fine of $1,500 in default of two months, twenty days.
His driving licence was also disqualified for six months.
Tiva however appealed his sentence and it was re-mitted to the Honiara Magistrates’ Court for re-sentencing.
He appealed on the grounds that the magistrate sentenced him under the new Amendment Act, which is not right as the offences were committed in 2008 when the new Act was not yet in force.
Tiva appeared yesterday in court but his case was further adjourned to June 24, this year.
This was because the court did not have a file.
Crown Prosecutor Nelson Dhita said the matter is a long outstanding matter since 2010 which has been remitted for re-sentencing.
He told the court that he had asked the court to re-list the matter which is why it was on the list yesterday.
He asked presiding magistrate Shepard Lapo if the court can give directions to the clerk to have the file ready on the next hearing date.
Mr Lapo also asked the Office of the Director of Public Prosecutions to produce the previous court decisions to court.
The case will return on June 24.
Tiva pleaded guilty to the traffic offences he committed between July 7, 2008 and July 8, 2008.
He was driving a G-vehicle to drop off- duty police officers at that time of the offending.
