The five men accused of the armed robbery outside the Bank of South Pacific (BSP) at Point Cruz earlier this year were not yet served with the amended charges laid against them.
The matter was adjourned from the last occasion so that the amended charges could be served to the accused persons so that they can enter their pleas yesterday.
Public Prosecutor Ishmael Kekou told the court yesterday that he had already served those amended charges to the investigation officers but is yet to receive feedback from the officers.
He apologized to the court for the delay.
Prosecution has amended the particulars or the wordings on the charge sheet in relation to five of the accused, Ben Farobo, Junior David Faiga, Stanley Ramo, Richard Rurai and Eric Junior Nathaniel.
The robbery charge sheets contains the names of the other two accused Billy Deodore and Milton Gwaliasi who were not part of the robbery but were alleged to receive part of the stolen money.
Their names were therefore omitted from the charge sheets and were to be served to the five accused so they could enter their pleas to the charge.
One of the lawyers yesterday confirmed to the court that his client did not receive the amended charge.
Meanwhile Mr Kekou also asked the court for some time to have some documents in relation to the bail applications intended to be made for three of the accused.
He needed the time to receive those documents and to make a response before the next court hearing.
Lawyers representing Farobo, Faiga and Ramo have put the court and prosecution on notice of an intended bail application.
The five accused are jointly charged with armed robbery charges in relation to the incident on the morning of 18 January outside of the former Westpac bank, now the BSP.
They allegedly robbed a carton containing $1 million from two Asians who were on their way into the bank to make deposits.
Prosecution alleged that while one of the accused waited in a car parked outside the bank, others went and attacked the complainant and grabbed the carton containing the money.
They allegedly escaped in the car but were shortly arrested, charged and remanded in custody.
Police alleged that the men were all masked and one of them was armed with a knife.
