A man facing a traffic offence that resulted in the death of another person at Aruligo, Northwest Guadalcanal last year has been given time to find a lawyer to represent him.
This was after Clifton Ruele of the Public Solicitor’s office, who was allocated the matter, informed the court he cannot represent Lionel Rifasia.
This is because the deceased’s mother is related to him.
Deputy Chief Magistrate Shepherd Lapo gave him time to find a lawyer and told him to return to court on June 14 with his lawyer.
Rifasi faces one count of causing death by reckless and dangerous driving in relation to the allegation on 1 November 2015 at Aruligo area.
It was alleged that the deceased was under the influence of liquor at that time of the alleged incident.
Prosecution further alleged the deceased was lying down on the road when the accused hit him with the vehicle he was driving.
He did not stop because of fears the other group of drunken boys beside the road might retaliate.
According to the allegation, a first car in front of the accused slightly touched the deceased who was standing on the road.
The driver of the first vehicle avoided the deceased and sped off for the same reason being that many boys were standing beside the road.
The deceased was lying on the road when the accused’s vehicle approached and allegedly hit him.
Public Prosecutor Ishmael Kekou is representing the State.
