A man who assaulted his sister luckily escaped jail yesterday after his three months imprisonment term was fully suspended.
Jackson Suluna pleaded guilty to one count of common assault, an offence that carries a maximum penalty of one year imprisonment term.
The incident occurred in Honiara on January 19, following an argument between the accused and his sister at his sister’s home.
The court heard on Tuesday that Suluna dragged his sister on the floor and then continuously assaulted her.
The victim sustained a bleeding nose as a result of the assaults.
She luckily escaped from the accused and then reported the matter to the police.
Principal Magistrate Tearo Beneteti said some of the aggravating factors she found in Suluna’s case is that he entered without the permission of the victim into her house, the victim’s nose was bleeding and the continuous assault he committed on the victim.
She however also took into consideration the fact that Suluna has no previous conviction, he entered an early guilty plea, he is a father of two children and that he is unemployed because of this case.
Having balancing the mitigating and aggravating factors, Ms Beneteti imposed a three months imprisonment.
She further ordered that the sentence be fully suspended.
She then warned Suluna not to commit further offences during those three months because if he did so, he will be sent to serve those three months in jail.
