THE High Court has dismissed the election petition case filed against Member of Parliament for North Guadalcanal, Dr Paul Popora Bosawai.
This followed a strike-out application made by Bosawai’s lawyer last week.
Judge Maelyn Bird on Monday delivered her ruling, which is in favor of Dr Bosawai.
Wilson Rano of Rano & Company said the court had accepted both arguments they raised in their application for strikeout.
“The two main grounds are: first the manner of service is not proper and second, the petition grounds are simply not sufficient to proceed to trial,” Mr Rano said.
Mr Rano said in accepting both arguments, the court dismissed the petition against Dr Bosawai.
Former MP for North Guadalcanal Samson Maneka filed the petition against Dr Bosawai on mostly bribery grounds.
Mr Maneka engaged private lawyer Billy Titiulu, while McChesney Ale of Rano & Company represented Dr Bosawai.
Dr Bosawai is a medical doctor and serves as the Minister of Health and Medical Services.
The petition case against Dr Bosawai is one of 26 petitions were filed against Members of the 12th Parliament following the April 17 National General Election.
The petitioner in the case against the MP for East Malaita and Minister for Infrastructure Development, Manasseh Maelanga has filed for a withdrawal, whilst the counsel representing the MP for East Choiseul and Finance Minister Manasseh Sogavare has filed for a petition strikeout.
