TWO Chinese nationals facing larceny charges here have been cleared of the allegations in the Honiara Magistrates’ Court this week.
Prosecution on Monday have asked the court to withdraw the larceny by servant charges against Xu Pie Ping (Female) and Zhau Zhen Wei (Male).
Police Prosecutor Wilfred Sura’au made the application without a file as the Police Prosecutors are again locked out of their office.
The application for withdrawal was made under section 190 (2) (b) (1) of the Criminal Procedure Code (CPC) before Chief Magistrate Emmanuel Kouhota.
This was after the Complainant in this matter did not want to further proceed with the case.
He attended court and confirmed wanting to have this matter withdrawn.
Under the section applied, Ping and Wei are acquitted and cleared off the charges.
They were previously accused of stealing more than $100,000 from the Happy Day Shop at Point Cruz.
Ping was working as a cashier at the Shop while Wei worked as a warehouse manager.
They were employed by the general manager of Happy Shop upon their arrival in Honiara in 2013 and allegedly said to have committed the offence in early 2014 when the general manger of the shop left for China for his holiday.
Chris Rarumae of Public Solicitor’s Office represented the accused.
