THE court has deferred its ruling as to whether or not the prosecution can tender the complainant’s statement in relation to the Care Centre burglary at Aruligo, West Guadalcanal.
Principal Magistrate Jim Seuika had requested a medical report that specifies the complainant’s condition.
Prosecution has tendered a medical report but was told it was too general and does not specify the complainant’s condition.
The complainant, the director and founder of the care centre, Br George Van De Zant SM, was unable to give evidence in court as he was sick.
The matter will return to court on November 20, to give time for the complainant if he recovers by then he can attend court and testify.
But if he is unable to come to court then prosecution will provide a specific medical report to the court to confirm that he is unable to attend court.
The court will then rule whether or not the complainant’s statement can be tendered as part of the evidence.
Hearing has already proceeded in the burglary and robbery incident that occurred early last year at San Isidro Care Centre at Aruligo.
Prosecution only called one witness and then made an application to the court if the statement of the Complainant can be tendered to court.
Misilisi Pua was accused of being part of a group of men who allegedly broke into Br George’s room and stole his personal belongings.
Pua is also standing trial for allegedly burning down the Mbabanakira police post in the Weathercoast of Guadalcanal on the early hours of 5 January 2013.
He faces one count of arson and one count of simple larceny for this incident.
Two prosecution witnesses have already testified in court early last week but the hearing was halted as other prosecution witnesses were not available.
The hearing for this particular matter is likely to resume soon.
Lazarus Kwaiga of Public Solicitor’s Office is representing Pua while Bradley Dalipanda is prosecuting.
