THE HIGH Court has deferred the hearing of the application to strike out the election petition case lodged against Member of Parliament (MP) for Central Kwara’ae Ricky Fuo’o to August 28.
This was because the lawyer of the petitioner – former MP for Central Kwara’ae Jackson Fiulaua had asked for more time to amend the petition over a typing error.
The petitioner’s lawyer Floyd FitzReggie of Rano & Company Tuesday objected the submissions for strikeout made by L & L lawyers who represents MP Fuo’o.
This is because they were s served outside of time ordered by the court.
Mr FitzReggie also objected the new issues raised in the submissions as they were not pleaded in the application.
He then filed the petitioners Notice of objection Tuesday and in the meantime, the petitioner will file sworn statements to address the new issues raised in the submissions.
Chief Justice Sir Albert Palmer therefore adjourned the hearing of the application for strikeout on August 28.
The petitioner made allegations of Illegal and Corrupt Practices (Illegal employment hiring) and Fraudulent Voting.
Fuo’o, in turn, through his lawyer made the application to strike out the petition on grounds of Abuse of Process which he said are frivolous and vexatious and that the allegation is insufficient to change the election result.
