ANOTHER bail application will be made anytime soon for the three young men accused of attacking another man last month at Lunga.
Lazarus Kwaiga of L & L Lawyers put the court and prosecution on notice, Friday of the intended bail application for William Ghiro, 18, Hensley Ghiro, 18, and John Areni, 25.
He said he intends to make the bail application soon as his clients are students.
The court had last month refused a bail application made for the accused for safety reasons.
This was because the alleged victim is in a critical condition at the hospital and if the accused were to be released on bail it will develop further repercussion.
The court last Friday heard the alleged victim is now being discharged from the hospital.
Public Prosecutor Freliz Fakarii told the court that police are yet to obtain the medical report of the victim plus his statement and that of two other civilian witnesses.
Deputy Chief Magistrate Shepherd Lapo urged the police to inform the court on the next court date, which is on March 17 on the status of the investigation.
He will be leaving soon for the province on a court circuit but he told Mr Kwaiga to write to the criminal clerk at the court’s registry office for the bail application to be heard by another magistrate.
The accused are facing charges of attempted murder and grievous harm in relation to the allegation on 12 February 2017 at Lunga Cross road at Henderson area.
Prosecution alleged the victim earlier in the evening had few beers with his brother in-law.
It was alleged that around 2am,, the three accused attacked him outside his in-law’s house.
They allegedly punched him on the face with a stone and struck his head and face with a mess wire.
One of the accused, allegedly at that time, also punched and kicked the alleged victim until he fell on the ground unconscious.
The victim was taken to the National Referral Hospital where he was admitted in a critical condition but was recently discharged.
