A 67-YEAR-OL D man who slapped his wife’s face at Tanagai market, West of Honiara in April has been given a bound over sentence.
Kiko Kaimanisi had pleaded guilty to one count of common assault.
He was initially charged with one count of domestic violence but that charge was later amended to common assault.
The defence has asked the court to consider the $500 that the defendant paid to his wife after the incident as sufficient punishment.
The defence also asked to consider section 35 of the Penal Code and that is to discharge the defendant without punishment.
For the sentencing submissions, Police Prosecutor, John Saugaro submitted to the court the defendant was under the influence of liquor at that time of the offence on 21 April this year.
He submitted that the defendant was not provoked and asked the court to consider the fact that the assault was done on a female whom is a vulnerable person.
“The victim is his wife, he should have respect for her and cherish her but instead he breached that trust,” Mr Saugaro submitted.
Principal Magistrate Felix Hollison having heard from both the prosecutor and the defence counsel imposed a bound over sentence of 24 months in the sum of $1,000 to keep the peace and be of good behaviour.
This means that for 24 months or two years Kaimanisi is to stay out of trouble and keep the peace.
If he commits another offence within the 24 months he will pay the $1,000 and also face new charges.
