THE lawyer for the Member of Parliament (MP) for Baegu-Asifola Tagini Makario has filed an application to strike out the petition filed against the parliamentarian.
The hearing of the application to strike out the petition has been listed for September 16 at 1.30pm.
High Court judge Howard Lawry set the date for the hearing when this matter went before him yesterday morning.
The petitioner in this case is Celsus Talifilu.
Mr Talifilu was a candidate for the Baegu-Asifola Constituency seat during the National General Election in April.
He lost his election bid and filed the petition against Makario on 13 grounds of Election Bribery.
MP Makario and his lawyer then filed an application to strike out the petition on grounds that it is frivolous and vexatious in nature.
They challenged the pleadings on the petitions where they were improper and lack merit for trial.
The petition case filed against MP for North Malaita, Daniel Suilea Waneoroa was also heard in the High Court yesterday.
Judge Michael Pitakaka who heard the matter set down September 16 at 9.30am for the hearing of the application to strike out the petition.
Former MP for North Malaita, Jimmy Lusibaea filed the petition against Waneoroa on two grounds of Bribery – one for Tampering and the other for Unlawful Voting.
Mr Waneoroa then filed an application to strike out the petition on similar grounds as MP Tagini.
Evan Olofia of L & L lawyers is representing MP Tagini and MP Waneoroa, whilst Mr Talifilu has engaged private lawyer Lily Ramo.
Mr Lusibaea has engaged Taupongi Law Practice.
