A HONIARA Magistrate has warned the police prosecution that he will strike off an attempted rape matter if they fail to appear in court on August 22.
Principal Magistrate Augustine Aulanga issued the warning yesterday when mentioning the matter of Eddie Paul in the absence of the police prosecution who are in carriage of this matter.
The matter was supposed to be for sentencing submissions but Public Solicitor’s lawyer Lazarus Waroka said he is still waiting for the draft of the agreed facts from the prosecution.
He also asked for a 14-day adjournment for that to happen.
Mr Aulanga therefore granted the adjournment and ordered both parties to sign and file in their submissions before the next court date.
He then warned that if no police prosecutor turns up in court on that day he will strike off the case.
Public Prosecutor Freliz Fakarii was present in court yesterday and stood in on behalf of the police prosecution.
She was asked to pass on the court proceedings and orders to the police prosecution.
