A trial involving a 42-year-old man accused of raping his 19-year-old daughter in 2011 has been vacated in the High Court yesterday.
This was because the alleged victim has reportedly left with her husband to a province to attend the death of a family member.
The hearing was scheduled to start yesterday before Justice Francis Mwanesalua.
However due to the absence of the victim yesterday, the trial was vacated and the matter further adjourned to this Friday.
The adjournment was made for the prosecutor to discuss with his superior if he can be excused from assisting in another upcoming trial to attend the possible trial of this rape case next week.
The court has a very tight schedule for this month but the lawyer who represents the father did not want a lengthy adjournment in this case to which the prosecutor also agreed.
The accused in this matter was accused of raping his daughter in his vehicle at Tenaru on August 10, 2011.
Prosecution alleged he took the alleged victim from her aunty’s house at Tenaru area under the pretence of taking her back home.
Ronald Dive of Public Solicitor’s Office represents the accused while Crown Prosecutor Nelson Dhita is representing the Crown.
