JAPANESE mining giant Sumitomo Ltd last Friday lodged a notice with the Court of Appeal to challenge the recent High Court ruling of its case against Axiom Mining Ltd.
The two mining firms have engaged in a long-drawn legal battle over mining rights on Isabel, which ended last month in the High Court when Justice John Brown ruled in favour of Axiom.
Sumitomo, in a statement, said it had made a detailed analysis of the decision and decided to file the notice of appeal to the Court of Appeals.
The appeal case is not expected to be heard until next year.
Sumitomo has been conducting prospecting activities in both Choiseul and Isabel provinces since 2005 for nine years.
The company said it maintains operational base camp in Isabel Province expecting and in preparation for possible activities next year.
Court of Appeal, granted interim orders against Axiom KB and others from entering areas.
