THE High Court will this afternoon deliver the verdict on the case involving the former president of the Solomon Islands Medical Association (SIMA) who was terminated last year for criticising government’s handling of COVID-19 measures.
Dr Claude Posala received his marching order in April 2022 under the Covid-19 State of Public Emergency.
He was the head of the Department of Ophthalmology at Honiara’s Regional Eye Centre at the time of his sacking.
His termination letter issued by the Ministry of Public Service (MPS) said Dr Posala had been critical of government action on Facebook and that he posted false information along with internal government documents online.
It said Dr Posala’s posts incited public hatred and a contempt to the government in breach of the Public Service Code of Conduct and regulations under the country’s State of Public Emergency.
In accordance with those emergency regulations, Dr Posala’s employment in the public service was terminated, the letter read.
His removal received widespread criticism from the public, given his experience and the work he had been doing for the country.
Following his removal, Dr Claude sued the government and the matter has seen a number of submissions, defence and hearings.
Speaking to Solomon Star this week, Dr Claude said all the hearings have been completed last month with final submissions to High Court Judge from both parties.
The presiding judge, Judge Maelyn Bird, will hand down judgment at 1:30pm.
The whatever the outcome, it is expected to generate a lot of discussions.
Since his termination, Dr Claude opened a private eye clinic in Honiara. He has also supported the Regional Eye Centre with surgical operations when requested.
